This policy is intended to comply with Colombian data protection law, including Law 1581 of 2012 (Ley de Protección de Datos Personales / Habeas Data) and Decree 1377 of 2013.
1. Who Is Responsible for Your Data
The entity responsible for the collection and processing of your personal data (the “Data Controller”) is:
Optima Health and Wellness SAS
Cra. 48 #19 Sur-100, Zona 2, Envigado, Antioquia, Colombia
Email: [email protected]
Phone: +57 305 4728234
2. What Information We Collect
Depending on how you interact with us, we may collect:
- Contact information – your name, phone number, email address, and location, typically provided when you reach out via WhatsApp, our website, or a scheduling form.
- Health information – laboratory results, symptoms, medical history, current medications, and other information relevant to a hormone health evaluation. Under Colombian law, health data is classified as “sensitive data” (dato sensible) and receives additional legal protection.
- Communication records – messages exchanged with our team via WhatsApp, email, or phone, kept for continuity of care and quality purposes.
- Technical information – basic website usage data (such as pages visited) collected through standard analytics tools, if enabled on our site.
3. Why We Collect This Information
We collect and use your information to:
- Coordinate laboratory testing and review your results
- Facilitate evaluation by a licensed physician and, when clinically appropriate, support the prescription process
- Communicate with you about your evaluation, treatment, scheduling, and follow-up care
- Maintain accurate medical records for continuity of care and monitoring over time
- Comply with applicable Colombian healthcare and data protection regulations
- Improve our services and communications
We do not use your health information for advertising or marketing purposes, and we do not sell your personal data to third parties.
4. Legal Basis and Consent
Because health information is considered sensitive data under Colombian law, we collect and process it only with your free, prior, express, and informed consent (autorización previa, expresa e informada). By providing your health information to us, whether directly through a form, through WhatsApp, or by sharing lab results, you consent to its collection and use as described in this policy. You are never obligated to share sensitive health information with us, though doing so is necessary for us to provide a medical evaluation.
5. Who We Share Your Information With
We share information only as necessary to provide our services, including with:
- Partner laboratories in Colombia, to coordinate and receive your blood test results
- Licensed physicians who review your case and make clinical determinations
- Pharmacy partners, only if a prescription is issued and you choose to fill it through a partner pharmacy
- Service providers that support our operations (such as scheduling or communication tools), under confidentiality obligations
We do not share your information with advertisers, data brokers, or unrelated third parties. We disclose information to regulatory or legal authorities only when required by Colombian law.
6. How We Protect Your Information
We take reasonable administrative, technical, and physical measures to protect your personal and health information from unauthorized access, loss, misuse, or alteration. Access to sensitive health information within our team is limited to personnel directly involved in your evaluation and care.
7. How Long We Keep Your Information
We retain your information for as long as necessary to provide ongoing care, comply with Colombian medical record-keeping obligations, and address any legal or administrative requirements. If you are no longer an active patient and request deletion of your data, we will do so except where retention is legally required (for example, minimum medical record retention periods under Colombian health regulations).
8. Your Rights
Under Colombian law, you have the right to:
- Know what personal data of yours we hold and how it is being used
- Update and correct your data if it is inaccurate, incomplete, or outdated
- Request proof of the authorization you gave us, where applicable
- Request deletion of your data, subject to legal retention requirements
- Revoke your consent for us to continue processing your data at any time
- File a complaint with the Superintendencia de Industria y Comercio (SIC), Colombia’s data protection authority, if you believe your rights have been violated
To exercise any of these rights, contact us at [email protected]. We will respond within the timeframes established by Colombian law.
9. WhatsApp and Third-Party Communication Tools
We use WhatsApp as a primary communication channel. Please be aware that WhatsApp is operated by Meta Platforms and is subject to Meta’s own privacy practices in addition to this policy. We recommend reviewing WhatsApp’s privacy policy separately. Avoid sending highly sensitive documents over any messaging platform if you are not comfortable with the platform’s own data handling practices; you may request alternative secure methods of sharing lab results or medical history by contacting us directly.
10. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. The updated version will be posted on this page with a revised “Last updated” date. Significant changes affecting how sensitive health data is used will be communicated directly to active patients where feasible.
